CONTEST RULES
This Contest is a skill promotion in which you are invited to conceptualize an original t-shirt design that represents your girlfriend getaway or get-together message. To do so, send us your detailed design iidea (or created graphic file) (“Design”). Designs that are offensive to any person or group, or that contain any words or graphics that are lewd or pornographic, or that are inconsistent with, or disparaging of, the integrity of Million-Dollar-Mama.com ("Sponsor") and it's affiliates will be disqualified.
ENTRY
This Contest may be entered in by submitting your entry via email at 12:01:00 A.M., July 21, 2007 and ending at 6:00:00 P.M., August 20, 2007 (“Term”). Please keep email attachments (electronic files) uner 1 meg. For purposes of these Official Rules (“Rules”), all times and dates are Eastern Time. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.
Ownership of Materials: All Entries must be your original work or intellectual property, must not infringe upon third party rights, nor previously have won awards, nor been published; and you must own the copyright to your Design. If you are declared a Finalist, Million-Dollar-Mama, at its sole discretion, may use your Design or a Design modified from your original idea to produce and sell t-shirts, without additional compensation to you.
Prizes: One (1) Prize: Winner will receive one (1) t-shirt (“t-shirt”). T-shirt style to be chosen by Million-Dollar-Mama. T-shirt size to be selected by Finalist. No substitution allowed except, at Sponsor’s sole discretion, a prize of equal or greater value may be substituted.
General Conditions: Each contestant by entering this Contest agrees that: [1] he/she will abide by and be bound by the Rules and Sponsor’s decisions; [2] the Entry will not be acknowledged or returned; [3] he/she hereby irrevocably assigns and transfers to Sponsor and its assigns all rights, title and interest in the Desing, including without limitation all copyrights, and agrees to sign all documents necessary to effect such transfer; [4] he/she hereby grants to Sponsor and its assigns the right to publish, use, adapt, edit and/or modify such Design in any way and in any and all media, without limitation, and without consideration to contestant; [5] the Releasees are not responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in this Contest or in any activity or travel related thereto or from interaction with, or downloading of, computer Contest information; [6] winner’s acceptance of any prize constitutes the grant of an unconditional right to use winner's name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [7] in the event of viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism, or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of this Contest, so that it cannot be conducted as originally planned, the Sponsor has the right to cancel, terminate or suspend the Contest; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable; [8] the Releasees are not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; [9] any portion of any prize not accepted or used by any winner will be forfeited; [10] the Releasees are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason; [11] Sponsor has the right to disqualify any individual found to be: (a) tampering or attempting to tamper with the entry process or the operation of the Contest or the Website; (b) violating the Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Contest property or service or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; [12] Sponsor has the right to lock out a contestant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter the Contest; [13] since any attempt by a contestant to deliberately alter or damage the Website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, Sponsor shall have the right to seek damages from any such contestant to the fullest extent permitted by law; [14]any dispute that arises regarding the meaning or interpretation of the Rules shall be resolved by applying the laws of Massachusetts, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts located within that state and [15] the prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
